Part- II VI. On the basis of the above proven charges, arguments, facts, evidence and legal grounds the plaintiff Blagoy Petrov Alexiev or Brian Alexis, who is also a US citizen, and pursuant to the Supreme Law, the Constitution of the Republic of Bulgaria, Article 7 according to which “the state is responsible for damages caused by unlawful acts or actions of its bodies and officials,” and on the legal basis of Art. 4 of the RSDA, the State owes compensation for all pecuniary and non-pecuniary damage, which is a direct and immediate consequence of the damage, and therefore the plaintiff Blagoy Alexiev asks the Supreme Court of Cassation to do the following: 1. The Supreme Court of Cassation of the Republic of Bulgaria to revoke, as unlawful and unconstitutional, Ruling No. 1324 / 12-15.04.2019 of the Sofia Court of Appeal, Chamber of Commerce, 13th panel, thus confirming the ruling No. 1774 of 22.01.2019 of the Sofia City Court, CD, I-1 Chamber, delivered on civil case No. 14526/2018, which returned the claim to the plaintiff Blagoy Petrov Alexiev, a victim of nuclear terrorism, against the respondent Prosecutor"s Office of the Republic of Bulgaria and its structures and terminated the proceedings. 2. The Supreme Court of Cassation of the Republic of Bulgaria to issue four court orders at the request of the plaintiff Blagoy Alexiev, a victim of nuclear terrorism committed in the United States, through which the state institutions listed in the four applications are required to provide the necessary documents for final disclosure of the killings by Bulgarian and Soviet secret services in the preparation and execution of nuclear terrorism committed by the proven agent and nuclear terrorist Anna Kilimnik in the United States through the use of Russian Ukrainian radioactive poisons and toxic elements manufactured and shipped to the United States in an amount of 600 liters, for the purpose of mass destruction of the US population. (See document # 2 - copy of the plaintiff"s four petitions for injunction) 3. The Supreme Court of Cassation of the Republic of Bulgaria to sentence the respondent Bulgarian Prosecutor"s Office and its structures in the face of the state of Bulgaria to pay damages to the plaintiff Blagoy Petrov Alexiev, in the amount of 10 million euro, in BGN for the crimes carried out by the respondent Bulgarian Prosecutor"s Office and its structures of general criminal nature and deliberate inaction and denial of justice to the plaintiff Blagoy Petrov Alexiev for the intentional criminal purposes of concealment of documents provided by the general Directorate for combating organized crime, where the respondent refused to institute criminal lawsuit against the KGB agent Anna Kilimnik (Anna May Alexis ) for criminal concealment of the criminal activities of an organized criminal group, fraudulent assessment of the Bulgarian estate property of Bulgarian natural and legal persons worth 826 805.00 (eight hundred and twenty-six thousand eight hundred and five euro) for the purpose of defrauding the plaintiff with tens of millions of US dollars, proven by the plaintiff to the Main Directorate for combating organized crime and submitted to criminal proceedings № 81/2011 on the inventory of the National Investigation Service of CDCOC in 2011. 4. The Supreme Court of Cassation of the Republic of Bulgaria to order for damages to be paid by the respondent the Bulgarian Prosecutor"s Office and its structures in the person of the State of Bulgaria to the plaintiff Blagoy Petrov Alexiev in the amount of BGN 50 million for committing crimes of a general nature, for criminal and deliberate inaction and willful denial of justice committed through the use of criminal methods against the plaintiff Blagoy Alexiev, for the purpose of criminal and deliberate concealment of nuclear terrorism committed in the United States against the plaintiff Blagoy Petrov Alexiev, for willful criminal complicity of the respondent Bulgarian Prosecutor"s Office and its structures in nuclear terrorism committed in the United States against the plaintiff Blagoy Alexiev, for systematic refusal by the respondent to convict the nuclear terrorist and mass murderer of US citizens Anna Kilimnik, for the purpose of organizing false expertise to be used by the respondent to systematically terminate the criminal proceedings against proven nuclear terrorist Anna Kilimnik - an agent of the Soviet secret services, and a massacre of US citizens. 5. The Supreme Court of Cassation of the Republic of Bulgaria to order damages to be paid by the respondent Bulgarian Prosecutor"s Office and its structures in the face of the state of Bulgaria to the plaintiff Blagoy Petrov Alexiev, in the amount of 130 million BGN, for intentional criminal inaction and denial of justice carried out using criminal methods, with the purpose of concealing the Russian -Ukrainian nuclear terrorism, by the use of special Russian radioactive poisons - weapons of mass destruction, primarily aqueous uranium-238 combined with toxic elements used by Anna Kilimnik (Anna May Alexis ) poisoning in order to kill ystvo the plaintiff Blagoy Petrov Alexiev, Bulgarian citizen or ( Brian Alexis ) and a US citizen, to conceal nuclear terrorism committed in the United States for deliberate refusal of the respondent Bulgarian Prosecutor"s Office and its departments to contact and request all documents from the Federal Bureau of Investigation of the United States providing a connection with the criminal activities of the nuclear terrorist from KGB Anna Kilimnik throughout the United States, for intentional refusal by the respondent to contact the US Department of Justice and formally request all documents and evidence of the plaintiff"s poisoning by the proven nuclear terrorist Anna Kilimnik and massacre of US citizens for complicity in nuclear terrorism carried out in violation of the US Patriot Act, adopted by the US Senate to protect US citizens from international terrorism, for conspiracy to torture and harass the plaintiff, and for complicity with the nuclear terrorist and mass murderer of US citizens Anna Kilimnik - an agent of the Soviet secret services, using Russian radioactive weapons (an aqueous solution of Uranium 238 mixed with radioactive and toxic elements) for the massacre of US citizens, including the attempted murder of the plaintiff Blagoy Alexiev or Brian Alexis. 6. The Supreme Court of Cassation of the Republic of Bulgaria to order for damages to be paid by the respondent the Bulgarian Prosecutor"s Office and its structures in the person of the State of Bulgaria, to the plaintiff Blagoy Petrov Alexiev, in the amount of 150 million leva for intentional physical, emotional and mental terror and harassment in order to accelerate the death of the plaintiff Blagoy Petrov Alexiev, who is the victim of a nuclear terrorism with life-threatening injuries resulting from slow and systematic poisoning with radioactive and toxic elements carried out on the territory of the US by the proven KGB agent Anna Kilimnik and conspiracy to commit deliberate terror and harassment of the plaintiff Blagoy Petrov Alexiev to accelerate his death. VII. CONCLUSION In conclusion, this political court case against one of the most criminal and terrorist state institutions in the European Union, as respondent, the Bulgarian Prosecutor"s Office and its structures, managed to put it mildly by the "organized Bulgarian Soviet Zionist crime", which is totally controlled by Soviet-Russian - Ukrainian secret services through their agents in Bulgaria and by persons described in more than 1800 documents with enclosures of documents attached to the claimant"s application and during the court proceedings, as well as in the text and this successive appeal, as prosecutors, investigators, police officers, magistrates and representatives of the state authorities in the Republic of Bulgaria, can lead to following legal conclusions: 1. The respondent Bulgarian Prosecutor"s Office and its structures have no legal right to functional immunity under the Constitution of the Republic of Bulgaria Article 132, para. 1, as stated by the magistrates from the Sofia City Court, CD, I-1 composition in the ruling No. 1774 from 22.01.2019, as there is no immunity for the respondent Bulgarian Prosecutor"s Office and its departments who committed crimes of a general nature, such as deliberate theft of documents, refusal to fulfill their functions as prosecutors, investigators and magistrates, complicity and concealment of nuclear terrorism committed against the plaintiff, participation in a conspiracy to terrorize and torture the plaintiff for the purpose of this physical, emotional and psychological terror and torment, aimed at accelerating the death of the plaintiff Blagoy Alexiev, a victim of nuclear terrorism committed in the US with life-threatening injuries sustained by systematic, slow poisoning with radioactive elements, basic aqueous solution of Uranium 238 mixed with toxic elements. by Anna Lvovna Kilimnik - a proven KGB agent and mass murderer of US citizens, for the same reason has no statute of limitations or immunity for magistrates of the Sofia City Court GO, I-1 panel, who drafted and signed Ruling # 1 774 of 22.01.2019 2. The respondent Bulgarian Prosecutor"s Office and its structures do not have any legal right to functional immunity under the Constitution of the Republic of Bulgaria, Article 132, para. 1, as stated by the magistrates from the Sofia Appellate Court, Commercial Division, 13 panel in Ruling № 1324 / 12-15.04.2019, as there is no immunity for the respondent Bulgarian Prosecutor"s Office and its departments, who committed crimes of general character such as deliberate theft of documents, refusal to fulfill their functions as prosecutors, investigators and magistrates, complicity and concealment of nuclear terrorism committed against the plaintiff, participation in a conspiracy to terrorize and torture the plaintiff with the purpose of this physical, emotional and psychological and harassment to hasten the death of the plaintiff Blagoy Alexiev, a victim of nuclear terrorism committed in the United States with life-threatening injuries sustained by systematic, slow poisoning with radioactive elements, mainly aqueous solution of Uranium 238 , carried out by Anna Lvov Kilimnik - a proven KGB agent and mass murderer of US citizens, there is no prescription period, no immunity for the magistrates from the Sofia Appellate Court, Commercial division, 13 panel who drafted and signed Ruling № 1324 of 12-15.04.2019. 3. The cited legal grounds of the magistrates in Ruling No. 1774 of 22.01.2019 of the Sofia City Court, Civil Division, I-1 Chamber, and in Ruling No. 1324 / 12-15.04.2019 of the Sofia Court of Appeal, Commercial Division 13 Panel, for inadmissibility of the plaintiff"s claims against the respondent - Bulgarian Prosecutor"s Office and its structures - are a gross violation of the Laws and the Constitution of the Republic of Bulgaria and legal absurdity. As a result of these unlawful acts committed by the magistrates of both courts, they became accomplices in crimes of general nature and accomplices in nuclear terrorism committed against the plaintiff Blagoy Alexiev, together with the respondent Bulgarian Prosecutor"s Office and its structures and at the same time proves and confirms the investigation of the European Commission on Justice that the Bulgarian judiciary system and the respondent in this political court case Bulgarian Prosecutor"s Office and its structures are totally under the control of the left government organized crime, whose activities are detailed in more than 1,800 pages of documents of the plaintiff Blagoy Alexiev against the respondent. 4. In accordance with US federal laws adopted to protect US citizens from terrorism, the respondent Bulgarian Prosecutor"s Office and its structures, together with all persons described in over 1800 pages of documents and involved in this political trial, including Sotir Tsatsarov Chief Prosecutor of the Republic of Bulgaria and the other government officials described above, are subject to prosecution, and the state of Bulgaria under the new terrorism law passed in the US can be convicted of nuclear terrorism and also complicit in nuclear terrorism and conspiracy to commit terrorism and harassment of US citizens - victims of nuclear terrorism in order to hasten their deaths through systematic terror and harassment. Anti-terrorism measures of the USA Patriot Act made substantial alternations in the statutes of limitation that govern a number of federal crimes. According USA Patriot Act Section §3286 (b) No limitation. - Notwithstanding any other law, an indictment may be found or information instituted at any time without limitation for any offense listed in 18 U.S.C. Section 2332(b))(g)(5)(B), if the commission of such offense resulted in, or created a forseeable (sic) risk of, death or serious bodily injury to another person. (emphasis added) Therefore pursuant to 18 U.S.C. Section 3286 (b) - there is no statute of limitations whatsoever on charges against anyone who: (1) committed torture; (2) aided and abetted the commission of torture; or (3) conspired to commit torture if any of those crimes either: (a) actually resulting in death; or (b) created a foreseeable risk of death; or (c) created a foreseeable risk of serious bodily injuries to another person.U.S. Justice Department citied the California case, People v. No Statute of Limitations For Prosecuting Terrorism Offenses, Consultation Draft of September 20, 2001, Anti- Terrorism Act of 2001, Section by Section Analysis, printed in, Administration’s Draft Anti- Terrorism Act of 2001: Hearing Before the House Comm. On the Judiciary, 107th Cong., 1st Sess.60 (2001) U.S. Patriot Act at Section 811. Penalties for terrorist conspiracies added to (g) Torture. – Section 2340 A of the title 18, United States Code, is amended by adding at the end the following: (c) Conspiracy. - A person who conspires to commit an offense under this section shall be subject to the same penalties (other than the penalty of death) as the penalties prescribed for the offense, the commission of which was the subject of the conspiracy.” With that text added to Torture - Section 2340 A of the title 18, United States Code, NO STATUTE OF LIMITTION for Conspiracy to cover up nuclear terrorist offence with Russian made radioactive poison is provided by U.S. Patriot Act 2001. All legal demonstration of federal laws and U.S. Patriot Act 2001 confirms No Statute of Limitation and immunity for Conspiracy to cover up Terrorism Offenses 18 U.S.C. Section 2332(b))(g)(5)(B), if the commission of such offense resulted in, or created a forseeable (sic) risk of, death or serious bodily injury to another person. 5. This political process against the respondent - the Bulgarian Prosecutor"s Office and its structures proves and confirms the determination of the European Commission on Justice that the Judiciary power of the Republic of Bulgaria is politicized and criminalized and controlled by organized crime and is a threat to the national security of the European Union countries and respectively the US state. V III. STATEMENT (DECLARATION) I, Blagoy Petrov Alexiev or Brian Alexis, declare that all documents attached to this political lawsuit against the respondent Bulgarian Prosecutor"s Office and its structures, are true copies of the originals and all the above documents along with many others disclosing facts for the concealed nuclear war against US citizens, have been sent to safe and secure places to protect the families of the victims and witnesses.
